Limited Warranty
Term Of Warranty
This warranty will run for a period of one year from the date of closing, or the date of occupancy, whichever occurs first, and unless a different period is hereinafter specified.
Warranty Coverage
Michael- James Development warrants that Your Home will be free from defects in material and workmanship on all floors, ceiling, walls, plumbing, heating and other internal structural components of the home which are not covered by other portions of this limited warranty.
Also covered under this warranty are doors; windows; electrical switches; receptacles; and fixtures; caulking around exterior openings; plumbing fixtures and cabinetwork.
All electrical wiring is warranted for a period of five years.
Manufacturers' Warranties
Michael-James Development will assign all manufacturers' warranties on all appliances and equipment to you at closing. The following are items that are included as appliances and equipment; refrigerator, cook top, double oven, dishwasher, garbage disposal, ventilating fan, air conditioning system, heating system and garage door opener.
Exclusions From Coverage
Michael-James Development does not assume responsibility for any of the following, all of which are excluded from the coverage of this limited warranty:
- Damage due to ordinary wear and tear, abusive use, or lack of proper maintenance of your home.
- Defects in appliances and pieces of equipment, which are covered by the manufacturer's warranty.
- Defects which are the result of characteristics common to the materials used, such as, (but not limited to) warping and deflection of wood; fading, chalking and checking of paint or stain due to sun light; cracks due to drying, shrinking and cracking of caulking and weather stripping.
- Defects in items installed by you or anyone else except us or, if requested by us, our subcontractors.
- Work done by you or anyone else except us or, if requested by us, our subcontractors.
- Loss or injury due to the elements.
- Conditions resulting from condensation on, or expansion or contraction of, materials.
- Consequential or incidental damages (sometimes called secondary damages).
Service Procedures
The service program is broken down in the following manner:
- We will receive one (30) day inspection report from homeowner. Accumulate all items covered under our warranty during the first (30) days of occupancy.
- We will receive an (11) month inspection report from homeowner. This sheet is for all other items covered under our warranty that may occur after your (30) day inspection.
- Please accumulate all items on inspection sheets unless it is an absolute emergency.
Repairs
Upon receipt of your service request at our offices, and if the defective items are covered by the Limited Warranty, we will repair or replace it at no charge to you, within sixty days (longer if weather conditions, labor problems or material shortages cause delays). Michael-James Development or our chosen subcontractors will complete repair work. The choice between repair or replacement is ours.
Drywall defects such as nail pops and tape cracking will be repaired and sanded. Same color paint will be applied to the repaired area only, which might result in a small variation in color from the original painting. Repainting of entire area will be at the owner's cost.
Non-Transferable
This Limited Warranty is extended to you only if you are the first purchaser of the home. When the first purchaser sells or moves out, this Limited Warranty automatically terminates.
No Other Warranties
This Limited Warranty is the only express warranty we give. Implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and habitability, are limited to the warranty periods set forth above. Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you. This Limited Warranty gives you specific legal rights, and you may also have other legal rights, which vary form state to state.
Note: Consequential and incidental damages are excluded and there are limitations to the duration of implied warranties. Some states do not allow the exclusion of limitations of incidental, consequential, or secondary damages, so this exclusion may not apply to you. |
